NEW DELHI, May 27 (Reuters) - Indian investigators have concluded Pernod Ricard withheld the age and composition of its Scotch whisky imports to hide their true value and pay lower tariffs, sparking a legal fight after the French company was asked to pay $314 million in back taxes, documents show.
Pernod PERP.PA, the maker of Chivas Regal whisky and Absolut vodka - which counts India as its biggest global market by volume - is seeking to quash a September decision by arguing that it was not given access to key pricing data in the investigation.
While the initial tax demand warning was reported by Reuters in 2022, hundreds of new documents - including investigation reports and submissions made at the Delhi High Court in recent months - reveal unreported details of the high-stakes battle.
In September, the Indian investigation concluded that Pernod "intentionally complicated" its disclosures with new internal malt codenames to make things more difficult for customs authorities when comparing its imports with those of its rivals, the documents show.
Pernod also did not declare "the true description of their imported malts (i.e. its exact composition and age) with the intention to hide the actual value of the imported goods and to avoid comparison," said an investigators' report that was contained in a government filing on January 24.
In a statement, Pernod India said it "rejects any suggestion of wrongdoing," maintaining that it has been fully compliant and it is "addressing this matter through the appropriate legal channels and remains confident in its position."
India's tax authorities did not respond to requests for comment.
India is asserting Pernod undervalued its bulk Scotch concentrate imports by 67.49%, sharply reducing the 150% tariff that New Delhi imposed. Such concentrates are blended with other ingredients like water and caramel to make whisky brands like Royal Stag.
The court documents show Pernod's tax liability currently stands at nearly 30 billion rupees ($314 million). With penalties, according to Indian law, the total payout could be more than $600 million if Pernod loses - an amount that is a fifth of its last year's Indian revenue of $2.9 billion - and three times its profit.
'GENERATE MAXIMUM PROFITS'
India is Pernod's biggest market by volume and it contributes roughly 10% of the company's worldwide sales. The tax dispute comes atop an antitrust case and a separate ban in New Delhi city that Pernod is battling due to allegations of liquor policy violations. Pernod has denied the allegations.
Despite its challenges, Pernod has been expanding in India, where it has 24 production sites. In 2024, it unveiled plans to open its largest malt distillery in Asia in Maharashtra state.
Investigators said the imports at the heart of the tax dispute were sent from Pernod subsidiary Chivas Brothers U.K. and the profits earned by undervaluing the whisky were transferred to the "ultimate holding company" in France.
"Utmost attempts were made by the Pernod Ricard Group subsidiaries to keep their expenses towards customs duty disbursements to the minimum and generate maximum profits" for Pernod India, they allege.
Chivas Brothers U.K. and a spokesperson for Pernod in France did not respond to queries.
PERNOD FIGHTS BACK
Pernod has told the Delhi court that Indian officials wrongly excluded dozens of other companies that imported Scotch concentrates at lower prices and instead selectively compared it to India's Allied Blenders and Distillers (ABD) ALLE.NS, whose import prices were higher.
The comparison was wrong as the quantity of Scotch concentrates imported by Pernod was on average 15 times higher than ABD's, Pernod said in its challenge. It also did not get access to complete import data used by investigators and so the findings are "grossly violative of the doctrine of natural justice," Pernod argues.
ABD did not respond to Reuters requests for comment.
The Indian government says Pernod's challenge should be dismissed because it was provided all relevant data and only ABD was "found importing similar goods at the comparable level."
TAX TUSSLES, CODENAMES CONTROVERSY
Prolonged tax disputes have often frustrated foreign investors in India and embroiled companies including Volkswagen VOW.DE.
The current Pernod dispute began in 2014 with a final tax demand order issued in September 2025. A year earlier, Pernod told authorities in a letter that the "inordinate delay" had "already caused grave prejudice to our business interests."
Some of the allegations in the ongoing tax case revolve around a contentious "codename" system used for the malts.
Investigators allege that Pernod in 2011 started using new, India-only internal codenames for its imported Scotch concentrates, even though the "ultimate product" made in India remained the same.
Pernod did not disclose composition details of such codes, which it described as RFM (Rich Fruity Malt) and HMW (Heavy Malt Whisky).
"Simple products of Scotland, i.e., Scotch Whisky manufactured using common and prescribed methods by Scotch Whisky Regulations in the U.K. were complicated just to avoid comparison with similar goods imported," the Indian authorities said.
Pernod in its documents has argued the new codenames were for a "bouquet of reconstituted Scotch malts."

May 15 (Reuters) - India's Allied Blenders and Distillers ALLE.NS is betting on premium spirits to drive future growth as demand remains resilient despite inflationary pressures stemming from the Middle East war, a top executive said on Friday.
Strong double-digit growth in the Prestige & Above (P&A) portfolio and its rising share in overall sales value are underscoring the firm's strategy of prioritising profitability over mass volumes, Managing Director Alok Gupta said.
"The mix shift is structural...the bulk of our future volume and value growth will come from Premium & Above and luxury segments," he said.
The P&A portfolio, which includes brands such as Millionaire Spirits and ICONiQ White, now accounts for about 47% of volumes and 58% of sales value.
Earlier this month, peer Radico Khaitan RADC.NS said consumers were drinking less overall, but were opting for more expensive and refined spirits. Allied Blenders, too, has not seen any change in consumption, particularly in its higher‑margin premium and luxury segments, Gupta said.
The company, maker of the Officer's Choice whiskey brand, expects overall EBITDA margins to expand by 300 basis points by fiscal year 2028. For fiscal 2026, margins rose to 14.4% from 12.7% a year earlier.
War-linked disruptions in March and early April delayed shipments to key Middle Eastern markets and depleted distributor inventories, though demand remained intact, the MD said, adding supplies are resuming, with restocking likely by June or July.
While short-term cost pressures persist, margins could remain steady if raw material prices ease, he said.
On Thursday, Allied Blenders reported a 48% drop in net profit to 409.7 million rupees ($4.27 million), hit by a one-time charge of 3.4 million rupees.
Net export revenue rose 14.1% to 2.35 billion rupees in fiscal 2026 from 2.06 billion rupees a year earlier.

Major Indian alcohol market Tamil Nadu shutters 15% of state's retail outlets
MUMBAI, May 12 (Reuters) - India's southern state of Tamil Nadu, one of biggest alcohol markets in the country, has ordered the closure of 717 state-run retail stores, roughly 15% of its outlets, citing public welfare.
Stores operated by the Tamil Nadu State Marketing Corporation which are located within 500 meters of places of worship, educational institutions and major bus terminals will need to shut down, the government said.
All alcohol retail stores in the state are operated by the government.
The decision was taken by Tamil Nadu's new chief minister, actor-turned-politician C. Joseph Vijay.
The closure process, framed as a public welfare initiative, is mandated to be completed within two weeks.
Liquor industry sources say Tamil Nadu's alcohol sales are dominated by local brands, though foreign companies such as Pernod Ricard PERP.PA and Diageo DGE.L do have a presence in the state.
The change in policy comes as the liquor industry is battling escalating costs from Iran war-linked disruptions and seeking price hikes.

Feb 20 (Reuters) - Allied Blenders and Distillers (ABD) ALLE.NS is banking on premium spirits and the India–UK trade deal to boost margins to about 18% by fiscal year 2028, its managing director told Reuters.
The liquor maker has been expanding its premium and prestige portfolio while widening distribution beyond its core markets, as India's growing base of affluent consumers splurge on higher-end spirits.
ABD also expects potential cost savings from the India–UK free trade pact, which will lower the tariff on imported bulk Scotch whiskey to 75% from 150%, supporting margins over the medium term, MD Alok Gupta said.
The company, known for its Officer's Choice whisky, expects margins to increase by 200 basis points by the second-half of fiscal 2027, with further gains after that. Its core earnings margin stood at 12.7% in fiscal 2025.
To support growth, the company has already invested 5.25 billion rupees ($57.7 million)to set up its own bottling units and allocated an additional 1.1 billion rupees in January to expand its in-house bottling capacity.
The premium spirits segment has been a key growth driver for larger peers such as Radico Khaitan RADC.NS and United Spirits UNSP.NS, indicating increasing opportunities in the sector.
ABD's luxury and super-premium business under the ABD Maestro brand is expected to double sales in the fourth quarter, Gupta said.
Post-COVID, the company has also seen more socialising at home and cocktails becoming mainstream, he added. "We've launched two flavoured variants and today more than 30% of our (sales) volumes come from flavours."
For the December quarter, the company reported a 16% rise in profit to 664.8 million rupees, even as revenue slipped 17% due to changes in excise duties.
